新文科理念下法学实践教学与法律职业资格考试的衔接

摘要

自新文科理念提出以来,在法考改革的背景下,法律职业资格考试不仅加大了案例比例,而且这些案例着力解决实际法律问题,设置的也比较灵活,允许考生自由发表观点,但是在实践教学与法考的衔接上出现了问题,上课偏理论化,实践课不受关注。而法考与实践教学衔接有其必要性,不仅有助于提升法考通过率,提高实践教学水平,也能促进学生实践问题处理能力的提升。因此,为实现法考与实践教学的衔接,应当更新法学实践教学理念,加大实践课程的比重,适时安排学生参与校外实习,建立实践课程教学评价体系,并教育引导学生注重培养自身综合法律职业素养和实践能力。

Abstract

Since the new liberal arts concept was put forward, under the background of the law examination reform, the legal professional qualification examination has not only increased the proportion of cases, but also focused on solving practical legal problems, and the setting is more flexible, allowing candidates to express their views freely. However, there are problems in the connection between practical teaching and law examination, and the class is more theoretical, and the practice class is not concerned. The connection between law examination and practice teaching is necessary, which not only helps to improve the passing rate of law examination, improve the level of practice teaching, but also promotes the improvement of students' ability to deal with practical problems. Therefore, in order to realize the connection between law examination and practical teaching, we should update the concept of practical teaching of law, increase the proportion of practical courses, arrange students to participate in off-campus practice when appropriate, establish a practical course teaching evaluation system, and educate and guide students to focus on cultivating their comprehensive legal professional quality and practical ability.
