On the protection of personal privacy rights in the context of government information disclosure
论个人隐私权在政府信息公开方面的保护

摘要

对个人隐私保护的重视是法治社会构建的必要组成，政府信息公开又是法治政府构建的题中之意，这二者目前存在一定的冲突。其实际上是知情权和隐私权之间的冲突。在客观技术条件日新月异的今天，数据虽然给人们的生活带来了巨大的方便，但是信息公开中的大数据调用等问题对个人隐私的保护亦造成了一定的威胁。运用法治化思维平衡隐私权保护和政府公权力关系，需要从法律上破除隐私界定困难，规范信息公开程序，完善隐私权受损救济途径。

Abstract

The emphasis on the protection of personal privacy is an essential component of the construction of a rule-of-law society, while government information disclosure is an inherent part of the construction of a rule-of-law government. Currently, there exists a certain conflict between the two. In fact, it is a conflict between the right to know and the right to privacy. In today's rapidly changing technological environment, although data has brought great convenience to people’lives, the use of big data in information disclosure also poses a certain threat to the protection of personal privacy. To balance the relationship between the protection of privacy rights and the public power of the government through a rule-of-law mindset, it is necessary to remove the difficulty in defining privacy from a legal perspective, standardize the procedures for information disclosure, and improve the remedies for privacy rights violations.
