摘要
“新宇公司诉冯玉梅商铺买卖合同纠纷案”作为判决违约方享有解除权首例裁判，同时《民法典》第580条第2款是否赋予违约方合同解除权，引发了理论界与实务界的广泛关注。违约方享有向人民法院提出解除合同的权利，而具体的是否构成合同僵局，以及是否支持违约方解除合同的请求，由人民法院具体裁量。而针对《民法典》第580条第2款与《九民纪要》第48条有效衔接等具体法律适用问题，仍需要相关司法解释予以进一步的完善。

Abstract
The case of Xin Yu v. Feng Yumei, the first case in which the defaulting party was given the right to rescind, and whether Article 580(2) of the Civil Code gives the defaulting party the right to rescind the contract, has aroused widespread concern in both theoretical and practical circles. The defaulting party has the right to propose to the People's Court to rescind the contract, and it is up to the specific discretion of the People's Court whether to constitute a contract impasse and whether to support the defaulting party's request to rescind the contract. For the specific legal application issues such as the effective connection between Article 580 paragraph 2 of the Civil Code and Article 48 of the Ninth Civil Code, it is still necessary for the relevant judicial interpretation to be further improved.
